Refund & Cancellation Policy

1. The general position

All sales are final and payments are non-refundable once the applicable product or service has been provided substantially as described at the time of purchase, except where otherwise expressly stated by the business or where a refund is required by applicable law.

We arrange access to date-specific, capacity-limited experiences. When a booking is confirmed, a vessel, vehicle, aircraft, table, room, guest list place or detail is held for you and is no longer offered to anyone else, and the third-party provider's own charges are typically committed at that point. That is the reason for this position.

2. When a service counts as provided

A service is treated as provided when it has been performed substantially as described in the booking we confirmed to you. Applying that to what this website offers:

A service is provided when it is made available to you as booked. Choosing not to use it, arriving unable to use it, or cutting it short does not make it unprovided.

3. Cancelling or changing a booking

To cancel or change a booking, contact us as early as possible using the details in section 11. A cancellation takes effect when we acknowledge it, not when you send it.

Before a service has been provided, what you may recover depends on the terms confirmed for your booking and on what the third-party provider will release. Once a provider has committed capacity, its charges are usually payable whether or not you attend.

We will tell you what a provider will release for your specific booking, and we will pass on any release we actually obtain, less any amount already irrecoverably committed.

Where we are able to, we may offer to move a booking to another date instead of cancelling it. Rescheduling is subject to availability and to the provider's agreement, and it is not a right.

4. Deposits

Two deposit terms are already published on this website and are stated here unchanged.

Exotic rentals: the $1,000 deposit is refundable

Our exotic rentals page publishes a $1,000 refundable deposit. That is a security deposit against damage, loss and charges arising during the rental. It is refundable in accordance with its terms, and nothing in section 1 of this policy makes it non-refundable. It is separate from the rental charge itself, which is subject to section 1.

Yacht charters: the 40% reservation deposit

Our yacht charters page publishes a 40% deposit to reserve for the vessel listed as "Creed". The published listing does not state whether that deposit is refundable.

Other deposits

A reservation deposit taken to hold capacity is applied to the price of the booking. Whether such a deposit is refundable, and on what terms, is set out in the confirmation for that booking.

5. Late arrival and no-shows

Bookings run to the schedule confirmed for them. Where minimums are published on this site, such as the two-hour minimum on one vessel, the three and four hour minimums in the chauffeur fleet, and the two-day minimum on car rentals, those minimums are payable in full.

If you arrive late, the booking still ends at its scheduled end time unless the provider agrees to extend it, and any extension is chargeable. Time lost to late arrival is not refundable and is not credited.

If you do not attend, no refund is due.

6. Weather, sea state and operator decisions

Marine, aviation and off-road activity depends on conditions. A captain, pilot, guide or operator may delay, shorten, alter the route of, or cancel an activity for safety, weather, sea state, airspace, mechanical or regulatory reasons. That decision rests with them and it is final.

Where an operator cancels an activity on those grounds before it begins, we will seek to reschedule it, and where rescheduling is not possible we will pass on whatever the operator releases.

Where an activity is delayed, shortened or rerouted on those grounds but still takes place, it is treated as provided.

Conditions you would prefer not to go out in, but which the operator is willing to operate in, are a client cancellation under section 3.

7. If we or a provider cannot supply

If a booking cannot be supplied at all, and the reason is not your cancellation, your conduct or a refusal under section 8, we will first offer an equivalent alternative or a reschedule. Our private jet page already states that equivalent aircraft may be offered where appropriate.

If you decline a reasonable equivalent and none can be arranged, we will refund the amount you paid for the part that could not be supplied, less any amount already irrecoverably committed to a third-party provider on your behalf.

Substituting an equivalent item, or a change of specific vehicle, vessel, aircraft, tail number, table, room or venue, is not a failure to supply and does not entitle you to a refund.

Section 20 of the Terms of Service governs events beyond our reasonable control.

8. Refusal of service

Where we, a provider or a venue refuses or discontinues service under section 15 of the Terms of Service, including for intoxication, impairment, unsafe or abusive conduct, breach of a provider's or venue's rules, failure to meet an age, licence, identification or insurance requirement, or non-payment, no refund is due and the full booked amount remains payable.

9. Third-party terms

Where you contract directly with a third-party provider, that provider's own cancellation and refund terms govern that service, and they may be stricter than this policy. Where a provider requires a deposit or fee that is non-refundable to us, it is non-refundable to you.

We do not control a venue's or restaurant's decision on admission, seating or timing, and no refund arises from such a decision except as section 7 provides.

10. Rights this policy does not affect

Nothing in this policy limits or waives any right you have under applicable law that cannot be limited or waived by agreement. That includes any non-waivable right under Florida consumer protection law and under any other consumer protection law that applies to you.

This policy does not apply to a charge that was genuinely unauthorised or made in error. Tell us and we will correct it.

[ATTORNEY REVIEW REQUIRED] Florida regulates certain categories of business that this business's service lines may fall within, including sellers of travel, and such regulation can carry mandatory refund, escrow, bonding, registration and disclosure obligations that override a published no-refund position. Whether any such regime applies here should be determined by qualified counsel before this policy is relied on.

11. How to raise a refund request

Contact us directly and include your name, the booking date and the service. We will review it and respond.

An approved refund is returned by the method used to pay, unless we agree otherwise with you.

12. Chargebacks

Please raise any billing concern with us before contacting your card issuer. Section 14 of the Terms of Service sets out what happens where a chargeback is raised for a service that was provided or for a booking cancelled outside its terms.
